Sentencing for Michael B. Daugherty, 26, of 505 West Larwill St., Lot 53, was continued Tuesday, Dec. 20 by Holmes County Common Pleas Judge Robert D. Rinfret so Daugherty can finish treatment for a drug addiction. Daugherty was scheduled for sentencing Tuesday on two counts of breaking and entering. He faces up to 24 months in prison on the charges.
Daugherty’s attorney, Jeff Kellogg, said Daugherty has voluntarily entered a treatment program. The program involves Suboxone, which is commonly used to wean addicts off opiates over time.
“(Daugherty) pleaded to his indictment to theft offenses some months ago,” Kellogg said. “Since his plea, I believe he has directed his attention to these problems.”
The charges against Daugherty stem from June 18 when he and Rodney R. Roper, 35, of 505 Larwill St., Lot 31, Wooster, and Steven R. Roper, 28, of 1855 Mechanicsburg Road, Wooster, were apprehended stealing copper wire in Holmes County. According to court records, a Holmes County Sheriff’s deputy observed a Chevy van parked off County Road 400 on an access road and saw two male subjects walking in the roadway. The deputy checked the area and found that a trailer owned by an electric company that was working on a job at a power station had been forcibly entered. The deputy returned to the van and made a traffic stop. Stolen items were recovered from the van.
Daugherty and Rodney Roper were arrested June 18 but Steven Roper escaped.
Rodney Roper and Steven Roper have pleaded guilty to related charges. Warrants have been issued for Rodney Roper and Steven Roper since, however, after they failed to appear for court-ordered appointments and/or hearings.
Daugherty said he feels the Suboxone treatment is helping him.
“The drug program I’m going through is helping me a lot,” Daugherty said. “I think that being willing to go reaffirms I’m willing to do it. I’d love to complete it so I don’t fall back.”
Rinfret said sentencing will be held “in a couple of months,” during which time adult probation will monitor Daugherty’s progress.
